The agreement between you and theSleepMD when you use thesleepmd.com, the SleepMD app, and our care programs.

The short version

  • These terms apply whenever you use our website or the SleepMD app, or book care with us. Creating an account or booking a visit means you agree to them.
  • We are a medical practice, not an emergency service. If you have an emergency, call 911.
  • Your clinician decides what care is right for you. Booking a visit or answering a questionnaire doesn't guarantee a diagnosis, a test, or a prescription.
  • You'll see what you owe before you pay, and you're responsible for anything your health plan doesn't cover.

Agreeing to these terms

These Terms & Conditions are an agreement between you and The Sleep Doctor PLLC, which does business as theSleepMD (“theSleepMD,” “we,” or “us”). They apply when you visit thesleepmd.com, use the SleepMD app for iPhone or Android, create an account, book or attend a visit, take a home sleep test, or order from our store.

By creating an account, booking an appointment, or using our services, you confirm that you have read and agree to these terms, to our Privacy Policy, and to the Telehealth Consent and Health Information Exchange agreement you accept when you sign up. If you don't agree, please don't use our services.

Not for emergencies

Our website, app, messages, and telehealth visits are not for emergencies. If you think you are having a medical emergency, call 911 or go to the nearest emergency room. If you are thinking about harming yourself, call or text 988 to reach the Suicide & Crisis Lifeline.

Messages to your care team are read during business hours and may not be answered the same day, so don't use them for anything urgent.

Who we are and what we provide

theSleepMD is a physician-led sleep medicine practice with offices in Texas, California, Virginia, North Carolina, Georgia, Florida, and Washington, and telehealth visits across the country. Our licensed physicians and clinicians evaluate and treat sleep conditions, such as sleep apnea and insomnia, and related health conditions, in person and by telehealth.

Depending on your needs and eligibility, our services may include:

  • Office and video visits with a sleep physician or another licensed clinician.
  • Home sleep testing, including wearable devices such as the SleepMD Ring, and the interpretation of your results.
  • Treatment programs, such as CPAP therapy, insomnia care, and medication-supported weight management for sleep apnea.
  • Prescriptions sent to the pharmacy you choose, when your clinician decides they are appropriate.
  • Our online store for CPAP supplies and other sleep products.
  • Secure messaging with your care team, your forms, and your records in the patient dashboard and the app.

Programs, prices, and availability may change, and not every service is available in every state or covered by every health plan.

Who can use our services

You must be at least 18 years old to create an account for yourself. For a patient under 18, a parent or legal guardian must create and manage the account, consent to their care, and be present at the start of their visits.

You agree to give us information that is true, accurate, and complete — including your name, date of birth, contact details, medical history, medications, and insurance — and to keep it up to date. Your care depends on it.

At the time of each telehealth visit, you must be physically located in the United States, in a state where your clinician is licensed to treat you.

Your account and signing in

You sign in with your mobile number and a one-time code we send you. Keep your phone secure, never share a code with anyone — we will never ask you for one — and tell us right away if you think someone else has accessed your account.

Each account is for one person. Don't create an account for someone else unless you are their parent, legal guardian, or legally authorized representative. You are responsible for activity on your account that happens because you shared access to it.

For your security, we sign you out after a period of inactivity, and we may ask you to confirm your identity — for example, with a photo ID check — before certain steps.

Your care

When you book with us, you establish care with a licensed clinician at theSleepMD, who uses their professional judgment to decide what is medically appropriate for you. Answering a questionnaire, paying for a program, or booking a visit does not guarantee a particular diagnosis, test, treatment, or prescription.

Information on our website and in the app is general education, not medical advice for your situation. Always talk with your clinician before you start, stop, or change a treatment.

You agree to follow the treatment plan you and your clinician agree on, to tell us about changes in your health, and to keep your primary care physician informed. We may recommend an in-person visit, a lab test, or care from another specialist when that is the safer choice.

Prescriptions and pharmacies

If your clinician prescribes a medication, we send it electronically to the pharmacy you choose. Your clinician may decline to prescribe, change a prescription, or stop a medication when that is in your best interest.

Some medications, including controlled substances, can be prescribed only when federal and state law allow, which may require an in-person exam or additional monitoring. Refills may require a follow-up visit.

Your pharmacy sets the price of a medication, and your health plan decides whether to cover it. We can't guarantee that a medication will be in stock, covered, or approved by your plan.

Home sleep tests and devices

If you take a home sleep test, follow the instructions we give you so the results can be read accurately. A test that is incomplete or done incorrectly may need to be repeated.

Readings from a sleep-test device, ring, or monitor are reviewed by your clinician as part of your care. They are not a diagnosis on their own, and the device does not watch over you during the night or alert anyone if something is wrong.

If a device is loaned to you, keep it in good condition and return it as instructed. You may be charged for a loaned device that is lost, damaged, or not returned, as described when you receive it.

Fees, insurance, and payment

We show you the price of a visit, program, or product before you pay. Program fees, copays, deductibles, and coinsurance are due when billed.

If you give us your insurance information, we will bill your health plan for covered services. Your plan, not theSleepMD, decides what it covers. You are responsible for any amount your plan doesn't pay, including services it considers not covered or out of network.

You authorize us and our payment processor to charge the card you provide for amounts you owe. Card numbers are handled by our payment processor; we keep only the card type and last four digits. If a payment fails or is disputed, we may pause non-urgent services until the balance is resolved.

Booking, rescheduling, and missed visits

You can book, reschedule, or cancel a visit in the patient dashboard, in the app, or by calling us. Please give us as much notice as you can, so another patient can use the time.

If you miss a visit or cancel late, we may need to reschedule your care, and a missed-visit fee may apply where we told you about it before you booked. Video visits open 15 minutes early; if you join late, your clinician may need to shorten or reschedule the visit.

Store orders, shipping, and returns

Prices for store items are shown at checkout. We ship to the address you give us and check that it can receive deliveries before you pay. Delivery times are estimates.

For health and safety reasons, opened or used medical supplies — such as masks, cushions, and tubing — generally can't be returned unless they arrived damaged or defective, or we sent the wrong item. Contact us as soon as possible after delivery about any problem with an order, and we'll work with you to make it right.

Some items require a valid prescription, and we may cancel an order if we can't verify one.

Calls, texts, and emails

By giving us your contact details, you agree that we may contact you by phone, text message, and email about your account, appointments, care, orders, and bills. We send one-time sign-in codes by text.

Optional text messages, such as care reminders, are sent only if you agree to them. Reply STOP to any text to stop receiving them, or HELP for help. Message and data rates may apply.

How we handle text messages

Using our website and app responsibly

You agree not to:

  • Use our services for someone else's care without their permission or legal authority.
  • Give false information, pretend to be someone else, or use someone else's account or one-time code.
  • Try to get prescriptions or medications for anyone other than yourself, or for misuse or resale.
  • Interfere with, overload, probe, or try to get around the security of our systems, or copy our content with automated tools.
  • Harass, threaten, or abuse our staff or other patients.

The website, the app, and their content — including text, graphics, logos, and software — belong to theSleepMD or its licensors and are protected by law. You may use them for your own care, but you may not copy, sell, or reuse them without our written permission.

Other companies' services

Some features depend on partners — for example, our electronic health record and telehealth platform, video-visit software, payment processing, identity verification, pharmacies, laboratories, shipping carriers, and the Apple App Store and Google Play. When you use a partner's service directly, its own terms and privacy policy may also apply. We aren't responsible for services we don't control, but we choose partners that are required to protect your information.

Your privacy

Our Privacy Policy describes how we collect, use, and protect your information. Your medical record is also protected by HIPAA, as described in our Notice of Privacy Practices, which you can request at any time.

Disclaimers

We work hard to keep our website and app accurate and available, but we provide them “as is” and “as available.” To the extent the law allows, we don't promise that they will always be uninterrupted or error-free, or that any particular result will come from using them.

Nothing in these terms limits the professional duties our clinicians owe you, or any right you have under law that can't be waived.

Limitation of liability

To the extent the law allows, theSleepMD and its physicians, staff, and partners are not liable for indirect, incidental, special, or consequential damages — such as lost data or lost profits — arising from your use of the website, the app, or the store. For claims about the website, the app, or the store, our total liability is limited to the amount you paid us in the 12 months before the claim.

This section does not apply to claims about the medical care you receive, which are governed by the laws that apply to healthcare providers in your state, and it does not limit any liability that the law doesn't allow to be limited.

Ending your account

You may stop using our services and ask us to close your account at any time. We may suspend or close an account that breaks these terms, puts our staff or other patients at risk, or is used fraudulently. If we end our care relationship with you, we will give you reasonable notice and help you continue care elsewhere, as medical ethics and the law require.

Closing an account doesn't delete your medical record, which we keep for as long as the law requires, and doesn't cancel amounts you already owe.

Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, except where the law of the state in which you receive care must apply. Before filing a claim, please contact us so we can try to resolve the issue informally. A dispute that isn't resolved will be handled in the state or federal courts located in El Paso County, Texas, unless the law requires otherwise.

Changes to these terms

We may update these terms as our services change, and the date at the top always shows the current version. If a change materially affects your rights, we'll tell you by email, text, or a notice on this site or in the app before it takes effect. Continuing to use our services after that means you accept the updated terms.

If any part of these terms is found unenforceable, the rest stays in effect. These terms, together with the documents they mention, are the full agreement between you and us about using our services.
